General Terms and Conditions of Business
1. GENERAL
These general terms and conditions, hereinafter referred to as GTC, relate to the sale and delivery of all products from this web shop.
By ordering products from this web shop, the customer accepts the following provisions of these GTC. The terms and conditions apply for an indefinite period and can only be changed by us. Changes must be made in writing.
2. OFFER AND ORDER
2.1 OFFER
Our offers in the web shop are non-binding. Small deviations and technical changes compared to our article descriptions are possible. In cases of unintentional or obvious typing, printing and billing errors, we are entitled to withdraw from the contract.
2.2 ORDER
When ordering online, we require information about the customer. At this point, the customer must enter contact information such as name, address, etc. This information is used exclusively for the creation and processing of the business relationship between the customer and michelangelo intimo GmbH and is not passed on to third parties. If michelangelo intimo GmbH has a problem processing an order, this information is used to contact the customer. The contract is concluded when the customer orders goods.
3. SHIPPING COSTS AND DELIVERY
The dispatch takes place in appropriate packaging with Swiss letter or parcel post. Unless expressly agreed otherwise, the benefit and risk are transferred from the sender to the customer when the goods are dispatched.

As soon as your package is handed over to the post office, you will receive a shipping confirmation by e-mail. This contains a link to the tracking number with which you can track the shipping status of your delivery online. Please note that the tracking number only becomes active once it has been recorded and updated by Swiss Post. Note: It may take several hours for the status to appear on the link.
3.1.2 DELIVERY OUTSIDE SWITZERLAND / ANY ADDITIONAL COSTS IN THE RECEIVER'S COUNTRY (incl. EU):
When shipping to other countries (except Lichtenstein), the sales price is reduced by 7.7% Swiss VAT; the credit card will be charged on the day of delivery - or at the latest 7 days after the order has been placed.
We draw your attention to the fact that additional fees such as customs, taxes and duties (VAT) may apply in the recipient country. We have no influence on these costs, they are not invoiced by us and are therefore paid directly by the customer. Please note the import regulations in your country.
3.2.1 PARTIAL DELIVERY
We are entitled to partial deliveries. In the case of partial deliveries, the shipping costs are charged only once.
3.2.2 DELIVERY DATE
Delivery in Switzerland is usually within 8 working days. In the event of delivery problems from our suppliers, longer delivery times may occur. We will inform you immediately and you have the option of withdrawing from the contract in writing within 10 days.
3.2.3 REFUSAL OF ACCEPTANCE
In the event of unjustified refusal to accept the goods delivered by us, we will charge for the costs incurred. Our right to fulfillment of the purchase contract remains unaffected.
4. PAYMENT METHODS

All credit card payments are processed using SSL technology (point 8 of our General Terms and Conditions). They are only charged on the day of delivery – or no later than 7 days after placing the order: your credit card is not charged on the day of the order, as is usual, but on the day of delivery.

INVOICE, RESERVATION OF TITLE
Ordering on account is only possible for our registered regular customers. This payment option is not available to you when you place your first order as a new customer. New customers please choose another payment method, for example prepayment. Or: After prior telephone agreement, we are happy to deliver on account. Please give us a quick call. The invoice amount is to be paid within 20 days of the invoice date without any (cash) deduction. In the case of a partial return of the delivered items, the invoice amount can be reduced accordingly. In the event of late payment, we charge default interest of 3% per month on the outstanding amount. We also charge a reminder fee of CHF 30 for each reminder, which is added to the outstanding amount plus interest on arrears. We will send you two reminders at most, after which we will initiate the operation. In any case, we retain ownership of the delivered items until the respective invoice amount for a delivery has been paid in full (final and unconditional credit of the total purchase price). michelangelo intimo GmbH is entitled to make a corresponding entry in the retention of title register.
No Cash on Delivery
No cash on delivery deliveries are made.
5. PRIZE
The prices include 7.7% Swiss VAT. Our settlements are made in Swiss francs (CHF). Our prices are generally non-binding. We hold the right for pricechanges.
6. EXCHANGE, RETURN, HYGIENE
All items from our shop, with the exception of bottoms, swimwear and discounted pieces, can be returned to us within 14 days. The prerequisite is that the goods are in perfect condition. The goods must be returned to us in the original packaging, stating the order number and/or a copy of the delivery note and the reason for the return. The customer is responsible for the return shipment and the postage for the return is at the expense of the customer.
We charge a 15% restocking fee. Underwear bottoms and swimming trunks cannot be exchanged for hygienic reasons. This is the only way we can guarantee that all the bottoms we supply are brand new and have really never been worn.
After prior telephone agreement, we can also grant a right of return on lower parts. However, we would like to verbally draw your attention to our conditions for fitting.
Items that have been reduced in price cannot be returned.
7. WARRANTY
If defects in the delivered goods are proven by the customer, we will pay for either the elimination of the defect or a replacement delivery within a reasonable period of time. If we are not able to do this, the customer has the right to choose whether to cancel the purchase or reduce the purchase price.
Excluded from the warranty are defects and faults for which we are not responsible, such as natural wear and tear, force majeure, improper handling, intervention by the customer or third parties, excessive stress or extreme environmental influences.
8. SECURITY AND PRIVACY
The data required for business transactions will be saved. All personal data will of course be treated confidentially and will not be passed on to third parties. The data between the customer and us is processed using the latest and proven secure socket layer technology (SSL). The SSL software encrypts all of your personal information such as credit card number, sort code, bank account number, name and address. We also meet the requirements of the PCI DSS (Payment Card Industry Data Security Standard).
We reserve the right to use your data to verify postal accuracy or to check credit. The credit card data is also encrypted. Each transaction is also authorized and checked online by the relevant credit card companies. Blocked or incorrect cards cannot be used.
Our website also uses cookies. Cookies are small text files that are stored permanently or temporarily on your computer when you visit this website. The purpose of the cookies is in particular to analyze the use of this website for statistical evaluation and for continuous improvements. You can completely or partially deactivate cookies in the settings of your browser at any time. If cookies are deactivated, you may no longer be able to use all the functions of our website.»
All credit card data that we accept are processed securely in accordance with PCI DSS (Payment Card Industry Data Security Standard). This is the global security standard of the international credit card organizations. The highest possible data security is guaranteed by encrypting the card data.
9. RESERVATION OF TITLE
The delivered goods remain our property until the amount owed has been paid in full.
10. JURISDICTION
Our business activities are based exclusively on Swiss law. Place of jurisdiction is Zurich-Opfikon. Swiss law applies exclusively, even if the goods are ordered from or delivered abroad.
The parties will endeavor to settle any disputes arising from the implementation of this contract amicably.
