General Terms and Conditions
1. General
The present general terms and conditions, hereinafter referred to as GTC, refer to the sale and delivery of all products from our webshop michelangelo.ch.
By ordering products from our webshop, the customer accepts the following provisions of these GTC. The GTC are valid for an indefinite period and can only be changed by us. Changes must be made in writing.
2. Offer and Order
2.1 Offer
Our offers in the webshop are non-binding. Minor deviations and technical changes from our product descriptions are possible. In cases of unintentional or obvious writing, printing, and calculation errors, we are entitled to withdraw from the contract.
2.2 Order
We require information about the customer for an online order. At this point, the customer must enter contact information such as name, address, etc. This information is used exclusively for the creation and processing of the business relationship between the customer and the michelangelo intimo GmbH and will not be passed on to third parties. If the michelangelo intimo GmbH has a problem processing an order, this information will be used to contact the customer. The contract is concluded when the customer orders goods.
3. Shipping costs and Delivery
Shipping is done in appropriate packaging with Swiss letter or parcel post. Unless expressly agreed otherwise, benefits and risks are transferred from the sender to the buyer upon dispatch of the goods.

As soon as your package is handed over to the post office, you will receive a shipping confirmation by email. This contains a link to the tracking number with which you can track the shipping status of your delivery online. Please note that the tracking number becomes active only after the post office has recorded and updated it. Note: It may take several hours for the status to be visible on the link.
3.1.2 Delivery outside Switzerland / Any additional costs in the recipient country (including EU):
When shipping to other countries (except Liechtenstein), the sales price is reduced by 8.1% Swiss VAT; the credit card will be charged on the day of delivery – or at the latest 7 days after the order is placed.
Please note that additional fees such as customs duties, taxes, and levies (VAT) may be incurred in the recipient country. We have no influence on these costs, they are not invoiced by us and therefore must be paid directly by the customer. Our customers must comply with the import regulations in their country.
3.2.1 Partial delivery
We are entitled to make partial deliveries. In the case of partial deliveries, the Shipping costs is only charged once.
3.2.2 Delivery date
The delivery times can be found on the product page of the respective item and range from 1-8 days depending on the product and stock availability. Delivery in Switzerland is made within a maximum of eight working days. If there are longer delivery times, we will inform our customers immediately. They then have the option to withdraw from the contract in writing within 10 days.
3.2.3 Refusal of acceptance
In the case of unjustified refusal to accept the goods delivered by us, we will charge the costs incurred. Our right to fulfill the purchase contract remains unaffected.

All credit card payments are processed using SSL technology (Point 8 of our T&Cs). The charge is made only on the day of delivery – or at the latest 7 days after the order is placed.

Prepayment, Switzerland: We will send you a QR invoice. With this, you can conveniently pay for your order in advance.

Cash payment upon collection at one of our locations in Uster or Niederhasli. Please contact us by phone in advance for this.
Invoice, Retention of Title
Order on account is only possible for our registered regular customers. This payment option is not yet available for your first order as a new customer. New customers please choose another payment method, for example Prepayment. Or: After prior telephone arrangement, we are happy to deliver on account. Please give us a quick call. The invoice amount is to be paid within 20 days from the invoice date without any (cash) discount. In the case of a partial return of the delivered items, the invoice amount can be reduced accordingly. In the event of late payment, we charge interest on arrears of 3% per month on the outstanding amount. In addition, we charge a reminder fee of CHF 30.- for each reminder, which is added to the outstanding amount plus interest on arrears. We remind at most twice, after which we initiate debt collection. Until full payment of the respective invoice amount of a delivery (final and unconditional credit of the total purchase price), we reserve the right to retain ownership of the delivered items in any case. The michelangelo intimo GmbH is entitled to make a corresponding entry in the retention of title register.
No Deliveries by Cash on Delivery
No deliveries are made by cash on delivery.
5. Price
The prices include 8.1% Swiss VAT. Our invoices are issued in Swiss Francs (CHF). Our price quotations are generally non-binding. We reserve the right to change prices.
6. Exchange, Return, Hygiene
All items from our shop, with the exception of bottoms, Swimwear and items reduced in price, can be returned to us within a 14-day period. The condition is that the goods are in perfect condition and that no identical items are returned (same product in the same color and size). Therefore, several copies of the same item should only be ordered if the correct size has already been evaluated (e.g., with a first order of the item in two to three different sizes). The goods must be returned in the original packaging with the order or invoice number and/or a copy of the delivery note and the reason for the return. The customer is responsible for the return shipping and the postage for the return is at the customer's expense.
We charge a fee of 15% for restocking. Underwear Bottoms and swim trunks cannot be exchanged for hygienic reasons. This is the only way we can guarantee that all Bottoms delivered by us are brand new and have never been worn before.
After prior telephone arrangement, we can also grant a return right on Bottoms. However, we would like to verbally inform you of our fitting conditions.
Items already reduced in price in our shop cannot be returned.
7. Warranty
If defects in delivered goods are proven by the purchaser, we will either remedy the defects or provide a replacement delivery within a reasonable time. If we fail to do so, the purchaser has the right to either rescind the purchase or reduce the purchase price at their discretion.
Excluded from the warranty are defects and disruptions for which we are not responsible, such as natural wear and tear, force majeure, improper handling, interventions by the customer or third parties, excessive use, or extreme environmental influences.
8. Security and Data Protection
The data necessary for business transactions will be stored. All personal data will, of course, be treated confidentially and will not be passed on to third parties. The data between the purchaser and us will be processed using the latest and proven Secure Socket Layer (SSL) technology. The SSL software encrypts all your personal data such as credit card number, bank code, bank account number, name, and address.
We reserve the right to use your data to check postal accuracy or for credit checks. Credit card data will also be encrypted. Each transaction will also be authorized and checked online by the relevant credit card companies. Blocked or incorrect cards cannot be used.
Our shop uses cookies. Cookies are small text files that are permanently or temporarily stored on your computer when you visit our shop. The purpose of cookies is, in particular, to analyze the use of this website for statistical evaluation and continuous improvements. You can deactivate cookies entirely or partially at any time in your browser settings. If cookies are deactivated, not all functions of our shop may be available to you.
All credit card data accepted by us are securely processed according to PCI DSS (Payment Card Industry Data Security Standard). This is the global security standard of the international credit card organizations. Maximum data security is guaranteed by encrypting card data.
9. Retention of Title
The delivered goods remain our property until full payment of the owed amount.
10. Jurisdiction
Our business activities are based exclusively on Swiss law. The place of jurisdiction is Uster, Zurich. Only Swiss law applies, even if orders are placed from abroad or deliveries are made abroad.
The parties will endeavor to amicably resolve any disputes arising from the execution of this contract.
